General terms and conditions of business
for orders in the SIRPLUS online shop

1. Scope

The following General Terms and Conditions (hereinafter “ GTC ”) apply to all contracts concluded between Lebensmittelretten ECOPLUS UG (limited liability), Taylorstr 13, 14195 Berlin (hereinafter “ we ” or “ us ”) and a consumer (m/f/d), which are based on an order placed by the consumer in the online shop at www.sirplus.de (hereinafter “ Online Shop ”).

You are a consumer (m/f/d) within the meaning of Section 13 of the German Civil Code (hereinafter “ BGB ”) if you, as a natural person, conclude a legal transaction for a purpose that is predominantly neither attributable to your commercial nor your independent professional activity.

By placing your order, you agree to the validity of the terms and conditions in their respective version.

2. Contract language, contract conclusion and contract text

2.1. Contract language

The only language available for concluding the contract is German.

2.2. Conclusion of contract

By placing the products in the online shop, we are not yet making a binding offer to conclude a contract for these items, but merely an invitation to place an order (invitatio ad offerendum).

You can add our products to your shopping cart without obligation and correct your entries at any time before submitting your order by using the correction tools provided and explained in the ordering process. Only by clicking the "Place order" or "Buy" button do you submit a binding offer for the goods contained in the shopping cart.

Immediately after submitting your order, you will receive a confirmation email, but this does not yet constitute acceptance of your offer. The contract is only concluded when we accept your order by sending a further email or when we dispatch the goods.

We reserve the right to set order limits for selected products.

2.3. Storage of the contract text

You will receive the contract terms and conditions, including details of the ordered goods, the terms and conditions and the cancellation policy, from us with the email confirming acceptance.

We do not save the contract text.

3. Prices and Payment

3.1. Prices

The prices listed on our product page at the time of your order apply. These prices already include VAT.

Shipping costs may be added to the stated product prices. You can find more details about the shipping costs in the respective offers.

3.2. Payment

The following payment methods are generally available in our online shop:

a) Credit card

We accept Maestro/MasterCard, Visa, and American Express for credit card payments. If you choose to pay by credit card, you must provide us with the requested credit card details, such as cardholder name, card number, expiry date, and security code, when placing your order. The payment transaction will then be processed automatically by the payment service provider. You will receive further instructions during the checkout process.

Credit card payment is possible for one-off orders and for subscriptions.

b) PayPal

If you choose to pay via PayPal, you will be redirected to the PayPal website during the checkout process. To pay the invoice amount via PayPal, you must be registered with PayPal or register first, log in with your access data, and confirm the payment instruction to us. After you place your order in the online shop, we will request PayPal to initiate the payment transaction. The payment transaction will then be processed automatically by PayPal. You will receive further instructions during the checkout process.

PayPal payment is possible for one-off orders and for subscriptions.

c) SOFORT transfer

After submitting your order, you will be redirected to the SOFORT Überweisung (SOFORT Transfer) website. To pay the invoice amount via SOFORT Überweisung, you must have an online banking account with PIN/TAN authentication enabled for SOFORT Überweisung, authenticate yourself accordingly, and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction will then be processed immediately by SOFORT Überweisung, and your account will be debited.

SOFORT transfer is only possible for one-off orders.

d) Vouchers

If you have a voucher, you can use it to pay for part or all of your order. To do this, enter the voucher code in the designated field during the checkout process. The voucher can only be redeemed for goods or services. Cash payment is not possible. Vouchers cannot be applied retroactively after your order has been received.

4. Delivery conditions

We only deliver to delivery addresses within the Federal Republic of Germany. 

Delivery can only be made via shipping. Unfortunately, self-collection of the goods is not possible.

During the ordering process, you will receive information about the expected delivery time. If the ordered goods are unavailable, we will inform you promptly via the email address you provided and either refund any payments already made or make you a comparable offer. Should you not accept the comparable offer, we will, of course, refund your payment. The refund will be issued via the same payment method you used for your original purchase.

Packages that cannot be delivered and have to be returned to us can be resent. However, you will be charged for the reshipping costs. 

5. Subscriptions

You can purchase certain goods or sets of goods from us on a recurring basis via a subscription. In this case, we will clearly and explicitly indicate that it is a subscription and any further special terms and conditions during the ordering process.

When you subscribe, the products will be delivered automatically according to the specified schedule. You can pay for your subscription by credit card or PayPal via direct debit. Payment is due upon delivery and must be made according to the chosen payment method.

You can pause your subscription for a limited time or change your address upon request. However, the pause can only last a maximum of 3 months at a time and a maximum of 6 months in any calendar year. You must submit these change requests to us in writing at least 10 days before the next billing date. The following subscription options are available:

a) Flex subscription

This subscription has no minimum term and can be cancelled at any time. You can send us your cancellation request with 10 days' notice before the next billing date via the cancellation button, or in writing to [email address/contact details]. Please inform us of any food rescue efforts by contacting ECOPLUS UG (limited liability), Taylorstr 13, 14195 Berlin , or via email at support@sirplus.de.

b) Savings subscription

This subscription has a minimum term of 12 boxes, but no longer than 2 years. It can be cancelled with one month's notice before the end of the term. If neither you nor we cancel in time, the subscription will automatically renew indefinitely and can be cancelled by either you or us at any time with 10 days' notice.

c) Sponsorship subscription for refugees

This subscription has no minimum term and can be cancelled at any time. You must submit your cancellation request in writing to us at least 10 days before the next billing date. Please inform us of any food rescues at ECOPLUS UG (limited liability), Taylorstr 13, 14195 Berlin, or at support@sirplus.de.

Outstanding debts

If you fall behind on at least two (2) payments within a subscription and the outstanding amount is not settled despite a reminder, we are entitled to terminate the contract without notice. SIRPLUS's right to claim damages remains unaffected by the termination. 

6. Warranty and Guarantees

6.1. Warranty

We are liable for defects in the purchased products in accordance with statutory regulations.

Please note the following:

We primarily sell food products that are either nearing the expiration of their best-before date ( "best before..." - BBD) or use-by date ( "use by..." ) printed on the packaging, or that have already passed their best-before date. This in itself does not constitute a defect. The best-before date does not indicate how long a food product can be safely consumed, but rather refers to "the date until which this food product retains its specific characteristics when stored correctly" (Art. 2 para. 2 letter r) of the Food Information Regulation). The shelf life of the food often extends considerably beyond the stated date. This is the difference between the best-before date and the use-by date. Naturally, we inspect the goods to the best of our knowledge and belief, in accordance with our legal obligations, and only sell food products that are suitable for consumption. In many cases, this allows you to purchase the products at a significantly lower price than in regular stores. We do not offer products whose use-by date has expired.

Due to these special circumstances of the purchase, we ask you to store the goods with particular care, refrigerated if necessary, until consumption and to consume them as soon as possible after purchase. Goods marked with a use-by date must be consumed before that date.

Despite regular, recurring, and thorough product quality checks by our quality assurance department, product defects can never be completely ruled out. Even though this is extremely rare, you are of course entitled to a suitable replacement in such a case.

6.2. Guarantees

Additional warranty rights arising from a quality and/or durability guarantee are only available to you if we have expressly issued such a guarantee for the respective goods.

Information on any additional warranties that may apply and their exact terms can be found with the respective product and on special information pages in the online shop.

7. Liability

We are always liable without limitation for claims arising from damages caused by us, our legal representatives or agents.

  • in case of injury to life, body or health,
  • in the event of intentional or grossly negligent breach of duty, or
  • in the case of warranty promises, if agreed.

We are liable for simple negligence on the part of ourselves, our legal representatives, or agents only in the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper performance of the contract and on which you, as the contractual partner, may regularly rely (cardinal obligations). In this case, liability is limited to the amount of damage foreseeable and typical for this type of contract at the time of its conclusion.
Further liability under the Product Liability Act remains unaffected.

8. Revocation

8.1. Cancellation Policy

(a) Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The following applies to the delivery of goods:
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

The following applies to subscriptions:
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the first goods.

To exercise your right of withdrawal, you must inform us ( You must inform Lebensmittelretten ECOPLUS UG (limited liability), Taylorstr. 13, 14195 Berlin , support@sirplus.de) of your decision to withdraw from this contract by means of an unambiguous statement (e.g. a letter sent by post or an email). You may (but do not have to) use the attached model withdrawal form.

To meet the cancellation deadline, it is sufficient that you send the notification of exercising your right of cancellation before the cancellation period expires.

(b) Consequences of the revocation

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods if this diminished value is due to handling of the goods that was not necessary for testing their condition, properties, and functionality. 

8.2. Exclusion of the right of withdrawal

The right of withdrawal does not apply in particular to contracts:

  • for the delivery of goods that are not prefabricated and for whose production an individual selection or specification on your part is decisive or which are clearly tailored to your personal needs.
  • for the supply of goods which are liable to deteriorate or expire rapidly,
  • for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery,
  • for the supply of goods if, after delivery, they have been inseparably mixed with other goods due to their nature,
  • Contracts for the supply of alcoholic beverages, the price of which was agreed upon at the time of conclusion of the contract, but which can be delivered no earlier than 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which we have no influence.

9. Youth protection & sale of alcohol

In accordance with the Youth Protection Act, we only deliver alcoholic beverages and food containing alcohol to persons who are at least 18 years old. We reserve the right to request proof of age (e.g., a copy of your ID). By submitting your order and accepting these terms and conditions, you also declare that you are of legal age and have full legal capacity, and that all your age, name, and address information is correct.

As a customer, you are obligated to ensure that only you or an authorized adult can accept the delivery of goods. If you, as a minor, place orders by providing false information and/or without the consent of your legal guardian or representative, we hereby revoke these contracts as a precautionary measure in accordance with Section 109 of the German Civil Code (BGB).

Upon delivery, the logistics provider may conduct an additional age verification if the person receiving the delivery gives reasonable cause for doing so. Delivery of ordered goods to persons under 18 years of age will not take place. Should the delivery be refused at your door due to the age verification, you will be responsible for the additional costs of returning the order.

10. Data protection

The protection of your personal data is very important to us. We process your personal data in connection with your order exclusively in accordance with applicable legal provisions, in particular the European General Data Protection Regulation (GDPR) and the German Federal Data Protection Act. Details can be found in the privacy policy available on our website.

11. Customer Service

12. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find at http://ec.europa.eu/consumers/odr/ . This is intended to give consumers the opportunity to resolve disputes relating to an online order without having to go to court.

However, we do not participate in dispute resolution proceedings before a consumer arbitration board and are not obliged to do so.

13. Discounts

Product-related discounts are generally only valid while stocks last. Free products can only be added to the shopping cart once per order. Combining discounts is not possible or only possible to a limited extent due to technical reasons.

13.1 Summer Sale
The tiered discount is automatically applied in the shopping cart based on the order value. This requires that at least one SIRPLUS product with a value exceeding €0.99 is in the shopping cart. The tiered discount can only be combined with the discount codes "MUS10" and "JUTE40".

13.2 Digital Wheel of Fortune Terms of Use

Our digital wheel of fortune on the website is available exclusively for individual purchases without subscriptions and can only be spun once per customer. The codes expire at midnight on October 3, 2023, and are usually easy to find on our homepage after a short waiting period. Please note that the codes are unique and can only be used once.

14. Other

14.1. Choice of Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This also applies if you order from a country other than Germany or if delivery is made to a country other than Germany. 

14.2. Place of jurisdiction

If your domicile or habitual residence is unknown at the time the lawsuit is filed, or if you move your domicile or habitual residence to another country after the conclusion of the contract, Berlin shall be the exclusive place of jurisdiction for disputes arising from or in connection with this contract.

14.3. Severability Clause

Should one or more provisions of these terms and conditions be wholly or partially invalid, this shall not affect the validity of the remaining provisions.

14.4. Reservation of right to amend

We reserve the right to amend these terms and conditions with effect for the future.

For existing subscription contracts, we will inform you of any changes before they take effect. If you do not object within one month of receiving the notification, the amended terms and conditions will be deemed accepted by you, provided that we informed you in the notification about the consequences of your silence.

As of May 2024
